INVESTIGATIONS

Unfortunately, workplace relationships will break down, and an investigation is required. Ideally, things can be worked out through dialog or a conflict resolution process, but when that does not happen, or it’s not appropriate for a given situation, a formal investigation may be required. 


Sometimes behaviours can be in violation of policies or legislation knowingly or unknowingly, and a competent person is engaged to determine if that is the case, and how it has come to happen if so.

Who is a competent person?

A competent person is someone who:

  • Is impartial and is seen to be impartial by the parties
  • Has knowledge, training and experience in matters related to workplace violence and harassment
  • Is knowledgeable with relevant legislation

What types of investigations do we do?

Investigations into allegations of:

  • Harassment in the workplace
  • Violence in the workplace
  • Discrimination in the workplace
  • Retaliation in the workplace
  • Sexual abuse and sexual misconduct
  • Violations of the Alberta Health Professions Act


How is an investigation conducted?

Typically, investigations involve:

  • Review of complaint and relevant workplace policies and legislation
  • Interviews of complainant(s), respondent(s), and witnesses
  • Review of supporting documentation from the employer, complainant, respondent, and witnesses
  • Analysis and assessment of information gathered
  • Conclusions or findings
  • Recommendations


When is an investigation required?

When an allegation of inappropriate behaviour that goes against an organization’s policies or relevant legislation is made, an organization has an obligation to follow up on the allegation. At times a formal investigation is required, and an external competent person needs to be engaged to conduct the investigation.
